Migrant Exploitation Protection Work Visa

The New Zealand Government has announced updates to the Migrant Exploitation Protection Work Visa (MEPV) to further enhance protection for migrant workers.

Effective from 31 October 2024, applicants are no longer able to obtain a second MEPV. This change supports the Government’s commitment to combatting migrant exploitation and protecting the integrity of New Zealand’s immigration system.

 

Key changes to the MEPV:

  • Second MEPV removal: as of 31 October 2024, migrants cannot apply for a second MEPV. Those holding an initial MEPV who attempt to apply for a second visa will have their application declined.
  • Initial visa period: migrants who report credible cases of exploitation may be granted an MEPV of up to six months or until their current visa expires, whichever comes first. This period enables migrants to safely leave exploitative conditions and seek new employment in New Zealand.
  • Application deadline for second MEPV: migrants whose initial MEPV expired on or before 30 November 2024 had until 30 October to apply for a second MEPV.
  • Refined definitions: the Government clarified that migrant exploitation must occur within a genuine employment relationship. Lawful employment terminations, non-payment of final wages due to liquidation, and redundancies are no longer classified as exploitation under the MEPV.

 

Reporting migrant exploitation

Migrants experiencing exploitation can report it to Employment New Zealand via their online form or by calling 0800 200 088. This service is free from any landline or mobile in New Zealand.
