Open work rights for partners of migrant workers announced

The New Zealand Government has introduced new rules from 2 December 2024, making it easier for more partners of migrant workers to get open work rights. These changes will allow them to work for any employer in New Zealand.  

To qualify, the partner must hold a Partner of a Worker Work Visa and their spouse or partner must hold an Accredited Employer Work Visa or meet other specific criteria. 

These changes aim to provide families of migrant workers with more job flexibility, which helps them settle more easily in New Zealand. 

 

Eligibility for open work rights 

From 2 December 2024, open work rights will be available to: 

  • All partners of AEWV holders working in an ANZSCO Level 1-3 role, earning at least $25.29 per hour (80% of the median wage for skilled residence visas). 
  • Partners of AEWV holders earning at least $25.29 per hour if they were already supporting a partner for a work visa on 26 June 2024. 
  • All partners of Essential Skills Work Visa holders earning at least $25.29 per hour. 

 

Additionally, open work rights will be available to partners of AEWV holders working in ANZSCO Level 4-5 roles if: 

  • They earn at least $47.41 per hour (150% of the median wage). 
  • They earn at least $31.61 per hour in a Green List role, meeting the Green List requirements. 
  • They earn at least $25.29 per hour (80% of the median wage) and meet the conditions of a role in the Transport or Care Sector Agreements, or earn the wage specified in the sector agreement (whichever is higher).

Applying for a variation 

Partners who already hold a Partner of a Worker Work Visa will be able to apply for a variation of their visa conditions from 2 December 2024 if their partner meets the new rules. This will allow them to move from restricted work rights to open work rights, giving them more freedom in finding work.
