The Australian Government has introduced the Migration (Specified Subclass 417 Work Exemption) Instrument (LIN 24/039) 2024, which will take effect from 1 July 2024. This legislative change aligns with the Australia-United Kingdom Free Trade Agreement (A-UKFTA) and brings significant updates to the Working Holiday Maker program.

 

Key changes and benefits

 

Removal of ‘specified work’ requirements

Under the new instrument, UK passport holders are exempt from the work requirements previously needed for the second and third Subclass 417 (Working Holiday) visas. This exemption removes the necessity for UK citizens to complete the specified work periods to qualify for visa extensions.

The specified work typically involves completing certain tasks in designated regional areas of Australia to be eligible for a second or third visa. Examples include agricultural work like fruit picking, construction labour, mining activities, and fishing or pearling tasks.

This change simplifies the process for UK citizens, allowing them to extend their stay without the need to fulfill these work requirements

 

Eligible passport holders and age range

Since last year, there has been a significant change for UK citizens applying for the Working Holiday (subclass 417) visa. Since 1 July 2023, the age limit has been extended from 30 to 35 years old, allowing applicants to apply up until the day before their 36th birthday. This means that the eligible age for UK applicants is 18 to 35 years inclusive.

 

Maximum stay of Ttree Yyars

The new policy extends the maximum stay for UK citizens to three years under the Subclass 417 (Working Holiday) visas, with each visa valid for 12 months. They have the flexibility to apply for their first, second, and third visas at different times, as long as they meet the age requirements. It’s not necessary to spend three consecutive years in Australia and applications for subsequent visas can be made from within or outside Australia.

For those who have already spent time in Australia under this visa before July 1, 2024, they can apply for the remaining visas under the new rules to reach the three-year maximum stay
