Every sponsorship or nomination application requires you to make known any adverse information that may impact your application.
But what is adverse information and why do you need to understand it when applying to be a sponsor or nominator?
According to the Department of Home Affairs website, adverse information is unfavourable information that could impact on your suitability as an approved sponsor.
Adverse information is information that could affect your suitability to:
- be an approved sponsor, or
- nominate someone for a visa
Adverse information could be about:
- you
- your organisation
- someone associated with you or your organisation
The Department of Home Affairs must be satisfied that a proposed sponsor or nominator, or a person associated with them, is suitable.
Examples of adverse information about a person includes information that the sponsor or nominator:
- has contravened or broken the law of Australia; or
- is under investigation, subject to disciplinary action or facing legal proceedings in relation to breaking or contravening an Australian law; or
- has faced administrative action, i.e. being issued with a warning for a possible breach of law by a Department or authority that enforces the law; or
- has become insolvent as per the Corporations Act 2001; or
- has given or caused to be given, the minister, an officer, the tribunal or assessing body a ‘bogus document’ or information that is false or misleading.
When completing your sponsorship or nomination application you must understand the meaning of adverse information in order to answer honestly.
