Employer Sponsored Visas

If you have an overseas foreign national that you would like to employ in an occupation that is difficult to fill from the local Australian labour market, there are a number of steps that your company must go through in order to get approval from the Department of Immigration and Border Protection (DIBP).

Eligible Australian companies must have a good business background, commitment to training Australian Citizens and permanent visa holders, show that the position to be filled is of a skilled nature and can not be sourced through the local Australian talent pool.

Be it through the temporary, subclass 457, Temporary Work (Skilled) or subclass 402, Training and Research visa, or as a permanent visa application made under the Employer Nomination Scheme, sponsoring companies must be robust enough to maintain market salary rates and their commitment to training Australian Citizens and permanent visa holders, in addition to adhering to DIBP's business Sponsor Obligations.

Overseas foreign nationals sponsored by an Australian business will need to have the skills, qualifications and/or relevant work experience to work in an skilled occupation from DIBP's nominated Skilled Occupation List.  In some cases, visa applicants may be called on to have their qualifications or skills assessed by one of Australia’s certified skills assessing authorities. In addition to your qualifications, applicants may need to provide detailed work references to support work experience.

Skilled Visas

If you have an occupation that is on the skills occupation list and have had a successful skills assessment for that application, are less than 50 years of age, have an acceptable level of English language ability and have been invited by DIAC to submit a skilled visa application, you may be granted one of almost 130,000 places available under Australia's skilled migration program.

With recent changes in the Australian economic and political landscape, there has been a number of changes to the skilled migration program.  Age restrictions, enhanced English language requirements and other legislative changes have greatly affected the application criteria and complexity of the application process.

Given that in excess of 1.5 million people apply for skilled visas each year, immigration advice is essential to ensure that your application puts you in the best possible position to secure permanent residency.  Seeking sound advice and preparing a solid immigration strategy is the first step in achieving your goal to live and work in Australia.

Family / Partner Sponsored Visas

The Family Stream is the second largest in Australia’s migration programme.  Many Australian Citizens and permanent visa holders see this as the perfect avenue to ensure that loved ones from overseas can join them to live and work in Australia.

Unlike the Skilled Stream, family visas are not subject to the ‘points test’ and in most cases age is not a restriction that make up the criteria for a successful application.  The family stream covers off visas ranging from Child, to Parent, Perspective Marriage, to Interdependent Partner. Australia also has provisions for family reunion for ‘remaining relatives’ who are the last close family member who does not have Australian Citizenship or a permanent residency visa.
